Terms of Service

These terms govern the relationship between anyone using punchla.com, the Punchla app or the wallet card and Nivorbit Teknoloji, which operates Punchla ("Punchla", "we"). Businesses that open an account are also bound by the Service Agreement and the Data Processing Agreement on the platform. 1. Customer account and card A Punchla account is opened with Google or Apple; the first tap or an invite link opens it and places the card in your wallet. The account is personal and cannot be transferred. You can delete it in the app; your cards, punches and rewards are deleted, and deleting the account does not affect a business's own records. 2. Punches and rewards Punches and rewards belong to the loyalty programme of the business that issues the card; the business sets and may change its terms (how many punches, which reward, for how long). Punches and rewards have no cash value and cannot be transferred or sold. A business may cancel a punch on abuse (repeated taps in one visit, forged punches). A programme may clear the punches of a card not used for 90 days; the card is warned 7 days before. 3. Business subscription Plans, prices and the trial period are published on the pricing page; prices for United Kingdom are shown without VAT; VAT is added at payment. The first 30-day trial starts without a card; if no plan is chosen at its end the account goes into limited mode, cards and customers are not deleted. A monthly plan can be cancelled at any time and ends with the period. An annual plan's price is fixed for 12 months. Payment is taken on a licensed payment institution's secure page; card details never reach Punchla. Invoices are issued to the account electronically. 4. The device The Punchla NFC device and counter stand are part of the plan, one per branch; ownership stays with Punchla. Until the device arrives, and whenever it cannot be used, the programme runs the same way on the counter card's QR. • Fault: free replacement for as long as the subscription runs; a new device ships, the faulty one is returned, shipping is on Punchla. • User damage (liquid, drop, breakage): the first replacement is free; the next ones are charged at device price (£59). • Lost or stolen: a new device at device price (£59). • Cancellation: the device is sent back to Punchla within 14 days, shipping on Punchla; if it does not arrive, device price (£59) is invoiced. 5. 30-day refund guarantee A business that withdraws within 30 days of its first payment is refunded in full; the device is returned, shipping on Punchla. No refunds after 30 days; a monthly plan can be cancelled at any time. 6. Notifications and messaging rules A business notifies its customers through Punchla; promotional notifications are limited to 2 messages a week within the hours the business chooses. A customer can turn notifications off at any time from the card or the app. The business is responsible for the content of its messages and their compliance with the applicable law (commercial electronic messages, UK GDPR); Punchla may stop content that breaks the rules. 7. Personal data How personal data is processed is explained in the Privacy Notice; the Data Processing Agreement also applies to businesses. Data is hosted in the EU (Germany). 8. Intellectual property and use The Punchla software, device design, brand and content belong to Nivorbit. The service is to be used for its purpose only; reverse engineering, automated bulk access, fake accounts and forged punches are prohibited. Accounts in breach may be suspended. 9. Liability Punchla provides the service "as is"; it does not guarantee uninterrupted access and announces planned maintenance in advance. Punchla's liability towards a business is limited to the subscription fees collected from that business in the 12 months before the event; it is not liable for indirect losses. A business's own programme, rewards and relationship with its customers are the business's responsibility. 10. Changes, law and contact When these terms change, the new version is published on this page and businesses are notified by e-mail; changes take effect 15 days after publication. Turkish law applies to disputes; the courts and enforcement offices of Istanbul (Çağlayan) have jurisdiction; consumers may also exercise their statutory rights. Contact: support@punchla.com.
